New York’s Hemp Industry in Limbo as New Regulatory Specifics Idle on Governor Cuomo’s Desk

When many people think of New York, scenes of Times Square and bustling streets may come to mind. However, New York state is more than New York City. In fact, the majority of the state’s economy outside of its infamous city is largely based on agriculture. Any many farmers have begun taking an interest in hemp since it became legalized.

In 2019, New York’s State Senate along with Governor Andrew Cuomo passed S6184A, a crucial bill effectively legalizing hemp extracts in the state. The bill lays out a much-needed regulatory framework on the production, processing, and commercialization of hemp extract products, such as tinctures, salves, and lotions.

Although the bill was considered a true watershed moment for stakeholders in New York’s budding hemp industry, a new challenge has arisen. Over 700 hemp producers across the state are now preparing to harvest thousands of pounds worth of hemp, which will then be sent to over 100 processing facilities across New York.

Unfortunately, New York hemp producers are operating under a temporary set of regulations and licenses granted by the state, which are set to expire at the end of October, right at the beginning of the harvesting season, effectively jeopardizing the entirety of New York’s hemp crop for 2020.

We spoke with Kaelan Castetter, vice-president of the New York Cannabis Growers and Processors Association (NYCGPA) and CEO of the Castetter Cannabis Group, about the status of the new regulations and what it could mean for hemp in New York.

“[Stakeholders] across New York’s hemp industry desperately need new licensing and regulatory guidelines,” Castetter said.

Castetter and other members of the NYCGPA have been working tirelessly to pressure the governor to release them but to no avail: “Nobody knows why the new regulations are sitting on Cuomo’s desk, but it is important that he release them as soon as possible.”

While Castetter could not confirm, it is likely due to the impact of COVID-19, which struck New York heavily earlier this spring, when it was the hotspot of cases in the country. However, revenue from hemp could help the economy, a state like many others now facing a serious crisis.

“Hemp won’t solve all of New York’s issues, but it could generate sizeable economic revenue for the state and create tons of opportunities for communities across the state,” noted Castetter.

A farmer himself, Castetter was quick to point out that New York has a strong agricultural pedigree, making hemp an ideal fit for the state’s agricultural sector.

“Whenever we talk about agriculture, most people think of states like Washington as primary growers for most of the produce we get today,” he said. “[But] New York has just as deep of an agricultural history. We are the second-largest producer of apples in the country.”

Indeed, New York is on the cusp of an agricultural revolution with hemp. A robust hemp industry has the opportunity to offer economic opportunity to multiple stakeholders within the industry, which has largely struggled due to price gluts for traditional crops.

“I know tons of people working in this industry from farmers to processors to CEOs of cannabidiol companies who are ready [to drive the industry forward].” Apparently, the only obstacle facing this potential growth is Governor Cuomo and the clock is ticking.

Will he come through before the final hour, which is rapidly approaching?

“We certainly hope so,” Castetter opined.

Study Reveals Gaps in Knowledge of Cannabinoids in Frequent Cannabis Users

When cannabis was illegal in every state, it was difficult for consumers to access credible information about what they were consuming. The situation is now quite different.

In many states, you can purchase cannabis from knowledgeable budtenders eager to describe terpene and cannabinoid content. Websites devoted to science-based cannabis education, including our sister publications Terpenes & Testing and Extraction Magazine, are great sources as well.

However, a study found that many of today’s cannabis consumers still have little cannabinoid knowledge despite greater access and available education.

Researchers from the University of Buffalo and Michigan distributed a survey to participants at the 2019 Hash Bash, an annual cannabis advocacy event held in Ann Arbor, Michigan. The 24-item questionnaire asked the 472 participants who responded to report effective doses of cannabinoids.

Over two-thirds of the respondents reported using cannabis daily, with the majority using it for medical purposes. While most admitted a knowledge gap in effective dosages, their estimates proved to be far from accurate–in fact, the authors reported that “participants’ average estimates for high-tetrahydrocannabinol (THC) (52%) and high-cannabidiol (CBD) (53%), as well as low-THC (28%) and low-CBD (30%) [cultivars] of cannabis, were considerably higher than the currently accepted definition.”[1]

Interestingly, men, European Americans, and those enrolled in medical cannabis programs had a greater understanding of effective dosages.

The majority of participants reported that their own experience guided most of their opinions about cannabis rather than information from their medical provider or other trusted source.

Co-author R. Lorraine Collins, PhD noted in a press release: “Our results suggest the need for broad-based cannabis education programs to help advocates and the general public to better understand and manage their use of [cannabis].”

In fact, many educational programs are popping up online with the goal of education for consumers.

 Lead study author Daniel Kruger, PhD concluded, “We really have to educate people. This has very real consequences because these compounds have differential effects.”

The INVEST in America Act Aims To Increase Access to Cannabis for Research

The US House of Representatives has proposed a new bill, entitled the Moving Forward Act, which would allow researchers to access cannabis in states where it is commercially available.

Cannabis researchers have been required to source cannabis samples from a federally licensed manufacturer located at the University of Mississippi, a considerable limitation to their work.

The changes appear in the form of a buried provision within the INVEST in America Act, which is a much larger piece of legislation aiming to reform national transportation, including implementing new transportation safety requirements, climate change reduction strategies, and extension of federal aid for various programs.

Another cannabis-related provision within the bill is to allow for the transportation of cannabis products across state lines, even in states that have not legalized cannabis markets. There is a caveat to this of course.

Under the Act, states will also be required to devise cannabis education programs to inform drivers about the dangers of driving while consuming cannabis. These programs are similar to drinking and driving reduction programs.

The highway safety provision has drawn criticism from cannabis law reform advocates who argue that such a provision unnecessarily equates cannabis with an increase in impaired driving.

Additional amendments/provisions to the bill, including testing wastewater for different substances, were proposed but shot down by legislators.

As of today, the INVEST in America Act has passed Congress and is currently awaiting approval from the Senate. If the bill passes the Senate, it will then be passed on to the next President for approval.

In all, despite the limitations, the Moving Forward Act within the INVEST in America Act has huge potential to improve multiple elements of the cannabis industry, marking a huge step forward in conducting much-needed, in-depth research on cannabis.

Fruit of the Earth Natural Health

Who they are: Fruit of the Earth runs a cannabis/hemp dispensary and online CBD store in Santa Fe, New Mexico. The CBD branch, known as Natural Health (also, the CBD and More Store), began in 2014 as the first in the state. The company adheres to organic cultivation to “honor the needs of our beautiful planet.” Packaging is generally recycled and/or made of biodegradable plant plastics. They even plant a tree for each purchase. Folks, that’s 90,000 trees to date. Talk about seeing the forest for the trees!

The CBD products come from Colorado hemp extracted using supercritical carbon dioxide—the “safe and superior method.” Although the website houses a page for third-party laboratory reports, they were not available at time of writing, so you should contact them to find out more. The company’s micronization process aims to bump bioavailability up “7-10 times” but the details are closely guarded.

Why they’re unique: Fruit of the Earth Natural Health strives to be eco-conscious, and their efforts pair uniquely with colorful product infusions.

What products they have: Tinctures, topicals, edibles, and softgels. There are lots of tinctures, so we’ll start there.

The first step in choosing a tincture is “microbotanica” or not—this refers to the micronization of CBD to increase bioavailability. As the company explains, “Less goes further, and you can truly FEEL THE DIFFERENCE!”

The tinctures come as full spectrum, broad spectrum, or isolate. Check out the micronized line with infused herbals for added umph. Happy Joints, for example, combines 400 mg CBD with devil’s claw, white willow bark, cat’s claw, and more. Cell Care features an uncommon blend of burdock root, sheep sorrel, turkey rhubarb root, and a number of other herbals “used for centuries to promote cellular recovery.”

Then there’s Calm, the potent purple tincture with lemon balm, lavender, and St. John’s Wort. Organic olive oil is the name of the tincture game. And this is just a glimpse—we don’t have the word count to cover all the bonus ingredients!

Several topical products are available with micronization, such as the Cedar & Pine Salve or the Lavender Salve.

What products they have: The single serving pack of peanuts pushes 1.7 ounces with 200 mg CBD. These can be purchased in party boxes of 3 or 6 packs for a true price discount. There’s also the bulk bag for a whopping 2,000 mg CBD. If classic salt seems too plain, fire things up with spicy Cajun.

Infused peanut butter is currently offered in a three-pack of individual servings with 100 mg CBD each. The ingredients are as simple as you’d expect: peanuts, peanut oil, butter, salt, and CBD oil.

Digital Holiday Sales Are Already Up & Expected to Climb, Particularly for CBD Brands

Amazon recently reported that the small and midsize businesses that sell on its marketplace made more than $3.5 billion during Prime Day. That’s a 60% increase over last year’s sales according to CNBC.

Although holiday shoppers’ wallets are billions of dollars lighter this year, there are still plenty of sales opportunities for market-savvy cannabidiol (CBD) brands.

Now Is The Time

Timing is everything, and the time to run holiday digital sales promotions is now.

Deloitte expects holiday e-commerce sales to surge by 25% to 35% with volume peaking between November to January.

And a survey by Coresight Research reports that three in 10 consumers expect to start their holiday shopping earlier than usual.

COVID-cautious Consumer Spending

With 31 million holiday travelers grounded this year and more than 47% of families reporting they are downsizing holiday events, this year’s holiday season will be dominated by “remote giving.”

Holiday shoppers’ traditional buying preferences and patterns are shifting in concert.

The three P’s of the promotional period–products, pricing, and promotions–don’t apply this year. This season is all about a brand’s preparation, perception, and pursuit, according to Michael Brown, a consumer market expert at Kearney.

CBD companies’ websites should be festive, fun, and filled with tons of sensational gift bundles.                Brands should invest more time in packaging and marketing offers. Banners like “great gifts for moms” and “deals for dads” provide purchasing cues that are likely to convert to higher-than-average cart size.

And they want their packages to arrive on time.

Shipping Slow Downs

Surges in online shopping are putting new demands on shippers, which are already straining to keep up with increased demand. CBD brands need to examine their shipping systems and have back-up plans in place.

Understand your delivery agent’s mailing performance and adjust customer promises accordingly. We recommend that brands create an automated customer shipping update to inform customers of any projected shipping delays. And, if service delays are anticipated, proactively issue special discounts or offers to recognize the inconvenience.

One way to avoid these predictable bottlenecks is to kick off holiday campaigns (and shipments) now to avoid the rush.

Gifts Cards Are On Trend

The most popular gift this year will likely be gift cards, according to Morning Consult, which reports that 48% of adults plan to buy or give gift cards this holiday season.

Three times as many shoppers said they will spend most on gift cards versus the next-highest gift type, clothing.

“The trend is real and it’s working,” says Scott Zabka, a CBD storeowner using CBD Marketing Hub to run live gift card campaigns.

According to Zabka the majority of recipients have become repeat customers.

We agree with the growing body of retail experts that recommend that brands examine promotional strategies to avoid over-discounting products–a move that ultimately drives down pricing and profitability.

Gift cards typically offer similar value to BOGO promotions but add a valuable kicker. They look and spend like cash, and consumers are more likely to redeem them and return to restock.

A Growing Need for Self-Care

The importance of self-care has become evident as a result of the pandemic and has risen to become one of the largest trends in the US.

Nearly one-third of consumers increased their self-care behavior this past year, according to IRI, which reports that nearly nine out of 10 Americans (88%) practice some form of self-care.

Many companies, including Austra, CBD for Life, Green Roads, Uncle Bud’s Hemp, and some Your CBD Store owners, are boosting their digital storefronts and in-store offers. Green Roads’ Self-care Deluxe Bundle is among trending gift items.

“[It’s] a really great gift, especially for stressed-out moms who need a break,” says Lee Sosin, CMO of Green Roads.

Oleamide: Intriguing Endocannabinoid Effects – CBD Health and Wellness

Oleamide is fatty acid amide found in the nervous system of mammals, with research indicating it can play a role in sleep induction. The process in which this occurs seems to involve the endocannabinoid system (ECS) and in particular the cannabinoid 1 (CB1) receptor. To better understand oleamide, we looked at a research review summarizing the evidence to date.

Pre-clinical studies have shown that oleamide is found in the cerebrospinal fluid during periods of sleep deprivation and that it has the ability to help encourage sleep.[1] Since oleamide is also found within human blood plasma, the possibility exists that the same effects might occur in humans.

To explore this possibility, an understanding of how oleamide uptake occurs within the central nervous system is necessary. Researchers used an agent known to block the CB1 receptor that also prevents other cannabinoid actions such as analgesia and memory disruption.[1]

The use of this receptor blocker eliminated the sleep-inducing and hypnotic effects of oleamide.[1] The amide was still present at levels that helped induce sleep under previous observation but these data indicates that oleamide is, in part, mediated through ECS pathways.

The presence of oleamide in human blood plasma demonstrates the potential for the compound to be further studied and analyzed for potential sleep inducing and calming benefits. Research into this human potential is lacking but the pre-clinical study described here shows another intriguing function and purpose of the ECS found within mammals. However, the review also pointed out that oleamide works with other systems in the brain, similar to how cannabidiol (CBD) has a widespread effect, not limited to the ECS.[1]

As we gain a better understanding of the ECS and how different compounds and substances, such as oleamide, interact with it, we stand to unlock further insight into this fascinating system found within the human body.

Sleep deprivation affects so many people, especially during this time of economic instability and other stressors associated with the pandemic. A natural way to induce sleep is greatly needed and further research will allow us to better understand safer ways to get those Zs.
